REGULATIONS: REQUIREMENTS AND CONDITIONS OF THE “MONNRY LOYALTY” PROMOTIONAL AND LOYALTY PROGRAM of Monnry Lighting SA

  • DESCRIPTION

This promotional program belongs to Monnry Lighting SA , who will henceforth be known as the “ Merchant ” or simply “Monnry” , or simply the “Sponsor” , on behalf of its frequent customer card “ Monnry Loyalty ”.

A.1 Monnry Loyalty is a program belonging to Monnry Lighting, designed to reward customer loyalty. Customers can access benefits such as discounts, products, exclusive promotions, events, and more as a result of their consistent purchases at the store.

Those wishing to participate in the Monnry Loyalty program must register directly at the Monnry store. The registration form, available at any time during regular store hours, must be completed.

Participating products for point accumulation are those sold at Monnry at their regular price without any discounts or promotions applied. Products in the Discounts or Fans sections do not qualify for points accumulation. However, if a product is part of a special offer, it may not participate in the program; this will be specified in the promotion's terms, conditions, and restrictions.

Regardless of the above, Monnry may also conduct special promotions, whether its own or in partnership with a third-party participant. These promotions will always have their own specific mechanics and are governed by the Sub-Regulations found at the end of this document. Additionally, if a promotion requires its own set of rules, all promotions will be governed by these, which are considered the general rules. These rules, when necessary, will be indivisible and complementary, especially when it comes to applying and interpreting each promotion and its specific mechanics. For any promotion or mechanics, participants must comply with the provisions of these rules, as well as any specific requirements for participating in each promotion.

Each promotion and its mechanics will be subject to dates and times that users and interested parties must adhere to. Several promotions may run simultaneously, but unless otherwise stated, they will be mutually exclusive; that is, they are different participation mechanisms in which customers may participate.

Monnry Lighting owns all copyrights arising from and related to the implementation of this program, including all advertising and all related printed or audiovisual support material used for the program and each promotion; as well as the use of electronic and cyber media, in addition to text messaging, wireless advertising and other media available to Monnry regarding its content.

Monnry does not claim rights over the brands of third parties that participate as co-sponsors and/or suppliers, and that may be mentioned in the advertising and other forms of communication of its promotions or the program.

Only individuals over 18 years of age may participate (Costa Rican citizens or foreign residents with legal status).

Benefits : These are primarily the products offered for sale at the Monnry Lighting store, redeemable according to the cardholder's points and in accordance with these Regulations. They also include, where applicable, prizes, discounts, or benefits that may be offered to all users or by customer segment or type, such as promotions.

Redemption: is the act of claiming “points” for products at Monnry Lighting, discounts, access to exclusive promotions or any incentive exclusive to cardholders.

Customer: This refers to any person who frequently purchases products from Monnry Lighting and subscribes to the Monnry Loyalty program, provided they comply with these rules and the applicable promotion and mechanics. When these rules refer to "interested party," it means a customer who expects to participate in and/or win a prize. All customers are considered "end consumers."

Winner: This is the person selected as such in a drawing and who, to be declared the winner, must comply with the rules and sign the corresponding document. It is also the person who receives a direct benefit (such as products). – “Winner”: the person who, having been selected and fulfilling all the requirements of a promotion, accepts the prize by means of a document prepared for that purpose.

Mechanics : These are the ways to participate in each promotion of the promotional program. – Sponsor: Monnry Lighting.

Products: These are all the products that Monnry offers in its establishments (except products in the discount area and fans); and all those that in the future will be integrated and promoted within the program.

Points: The sum of credits or points earned by the cardholder when making purchases at Monnry stores during the term of the Monnry Loyalty Program and in accordance with these Regulations. These points can be used to obtain benefits offered by the program or converted into electronic entries to participate in promotions. The term “points” is symbolic, as they are not physical or printed, but rather accumulated electronically and stored in a database. Only points earned in accordance with the regulations are valid for participation in both the program and each promotional drawing.

Regulations: This document.

Monnry Loyalty: The program regulated herein. Belonging to Monnry Lighting and Home Accents SA. Granted to each member who complies with these regulations and possesses a special card, authorized and issued by Monnry Lighting. This card must be presented with every purchase of authorized products to accumulate points.

  • VALIDITY PERIODS, POINTS AND MODIFICATIONS

The Monnry Loyalty Program will remain in effect until the sponsor decides to discontinue it, at which time it will be terminated immediately upon public announcement. The program may also be modified without prior notice, but any changes will take effect upon publication of the program's regulations on its website https://www.monnry.com, on social media, in-store in-store, or through any other publicly accessible digital or print medium. The points accumulated by the cardholder will automatically expire on August 31st of each year, as detailed later in this agreement.

PARTICIPATION: ON CARD MANAGEMENT AND WAYS TO ACCUMULATE POINTS

To actively participate and accumulate points in the Monnry Loyalty Program, cardholders must present their Monnry Card at the register each time they make a purchase at a Monnry Store of authorized products or use it for their purchase. Only then will points be credited. It is essential that the cardholder present their card to the cashier before the purchase receipt is printed; failure to do so will result in the loss of points for that purchase, as the system does not allow it for security reasons. Each Monnry Loyalty Program member may have only one active account. When a new account is requested due to the loss, theft, or misplacement of the previous card, the original card will be automatically and permanently deactivated, without losing any points. This process must be requested directly and in person at the store, presenting identification. A new code will be generated and the reported card will be canceled within 5 to 7 days. The benefits of the Monnry Loyalty Program are exclusive to Monnry Loyalty Program members and are non-transferable, as detailed below. Each time you purchase authorized products at a Monnry store and present your card at the register before the purchase is processed, the cardholder will automatically accumulate the number of points to which they are entitled. Each point has a redeemable value at Monnry Lighting, and points are earned as follows: For every $10 spent, you accumulate 1 point on your card, with a maximum reward of ¢250,000 (two hundred and fifty thousand colones) per year or its equivalent in US dollars according to the exchange rate. However, the sponsor may, for as long as it deems appropriate, establish special bonuses, as well as double, triple, or higher points for the purchase of certain products; this may be for promotional purposes, product launches, or inventory adjustments. This may also apply to some of the segments referred to in the following article.

Cardholders will be divided into Premium, Artist, or Business categories based on their purchasing profiles. This category is determined by the cardholder's annual purchasing activity, as explained in the following points. To qualify for one of the aforementioned levels, the cardholder must have one of the following purchasing profiles:

Premium : Retail buyers, for self-consumption.

Artist : Professionals in fields such as architecture, interior design, and others who work as decorators or space designers for third parties. These professionals must actively commission Monnry Lighting and meet the conditions for this provision. This card is not publicly available and requires an application that will be reviewed and evaluated by Monnry Lighting.

Business : Companies with legal status, registered and with a legal certificate.

The cardholder will be able to enjoy the following benefits, according to the preferential classification obtained by him/her:

  • Monnry Loyalty – Premium: Redeem points for authorized Monnry products, promotional items, special discounts, access to exclusive events and promotions.
  • Monnry Loyalty – Artist: Monnry commission system, exclusive royalties, access to exclusive merchandise, seasonal benefits.
  • Monnry Loyalty – Business: Exchange for storage, discounts, exclusive promotions, priority attention in the development of proformas and more.

To achieve and maintain any of the preferential tiers, the cardholder must meet all applicable requirements, as previously stated. Applying for one card precludes applying for either of the other two, limiting cardholders to a maximum of one card per purchaser and/or representative. The physical and visual design of the card differs across the three tiers. The points accumulation mechanism applies year-round to regular purchases, excluding items in the Discounts and Promotional areas. Points may be redeemed year-round for authorized products as stipulated in this agreement. The cardholder will be credited or have points deducted for each purchase or redemption registered in their name, according to the terms and conditions. Current redemption options will be available in-store and online. This redemption table may be changed at any time without prior notice; the table displayed in the store on the date of inquiry will apply. The account will begin accumulating points once the customer receives the card that accredits them as a member of the Monnry Loyalty Program and presents it for the first time. Cardholders may not redeem points when using the online shopping service, but only when making purchases in person at a Monnry Lighting store. The sponsor will not be responsible for replacing points on a lost card if the accumulated points were redeemed before the cardholder reported the loss, as established in these Regulations.

Each product will have a defined point value for redemption. The customer must have the minimum number of points indicated in the redemption options to make a redemption and can complete the required points by paying additional amounts in cash beyond the purchase price, as previously established in this agreement. Each Monnry Loyalty program member can check their points balance at the Monnry Lighting store checkout area. Under no circumstances may the customer redeem their card points for cash or any other goods not specified in the redemption options. To redeem products, it is essential to present the Monnry Loyalty card and the user's identification card; this is an internal security measure.

  • MECHANICS

The following guidelines are established for the redemption of points:

For each point redemption made by a customer, the points used will be deducted from their accumulated points, according to the redemption rule established in this contract above.

All points accumulated by a cardholder, whether from purchases or bonuses, will expire on August 31st of each year. Points can be accumulated from purchases of regularly priced items, excluding fans and discount items. Furthermore, points can be applied or redeemed year-round on purchases from the discount area and on regularly priced items, but not on fan purchases.

This policy is based on the following redemption terms: for every 100 points accumulated, the cardholder will be entitled to a $20 discount on their purchase of authorized items. It is understood that Monnry Lighting may set the redemption period it deems appropriate and/or add other special offers, as well as establish double, triple, or higher points for the purchase of certain products; all of this for promotional purposes, product launches, or inventory management.

  • LEGAL

USE OF INFORMATION CREATED IN THE DATABASE

Anyone who joins the program or receives prizes, discounts, or benefits will be added to the Monnry Lighting and Home Accents SA database. For marketing purposes, Monnry may use this information at its discretion and confidentially to send offers and promotions, as well as information about other products and services. If a user does not agree to have their name appear in the database, they must request to be removed. It is understood and fully accepted by the cardholder that when presenting their Monnry Loyalty card at the checkout, Monnry Lighting and Home Accents SA may keep an internal record of the products the cardholder purchases, as well as the promotions they take advantage of. The sponsor will not share individual personal information or information about individual purchases with third parties, except when necessary to comply with any legal requirement.

INTERNET USE AND OTHERS

Monnry (or its technology provider) has its own equipment and processing system to manage the site and database, which has been tested and verified. However, due to power outages or any fluctuations in electricity, or similar events, or even problems with access lines, whether telephone, cable, or wireless, that cause transmission interruptions or a blockage of the system, either partially or completely, Monnry will attempt to resolve the issue but will not be liable for events beyond its control. Monnry will also not be liable for acts of God or force majeure that affect the services described herein, including, but not limited to, floods, rain, hurricanes, tremors, earthquakes, demonstrations, work stoppages, strikes, armed or civil movements, riots or any type of civil unrest, transportation delays, road closures, and, in general, any natural event or human action beyond Monnry's control.

  • LIABILITY, CONDITIONS AND RESTRICTIONS

The advertising for this program and the websites contain links indicating that participation, the promotion itself, and the prizes are subject to conditions and limitations. These conditions and restrictions are those set forth in these regulations and on those websites. This promotional program is governed by these Regulations and the mechanics of each promotion. National legislation, judicial and administrative jurisprudence, and consumer commission resolutions are also incorporated in a supplementary and complementary manner, insofar as they are applicable. The sponsor reserves the right to determine, in accordance with the interests of the activity and consumer rights, the instances in which the preceding articles are violated. Should any such circumstance occur, it will be recorded in an official statement from Monnry Lighting, either issued on the day of the drawing or, if the event occurs or is discovered subsequently, in a separate report, if necessary. Otherwise, the document issued will suffice. The evidence supporting actions such as those described in the preceding points will be that which, in accordance with judicial principles and laws, is most common and/or permitted by the Courts of Justice. Any matter arising from the program that is not covered by these regulations or the mechanics of each promotion will be resolved by the sponsor in strict accordance with the laws of the Republic of Costa Rica. The sponsor reserves the right to temporarily or permanently deactivate Monnry Loyalty cards without any liability on its part when the cardholder's information is not properly updated in the sponsor's database or the card has not registered any purchases for a period of two years. The sponsor will have the right to request the cardholder to update their information; if the information is not updated within the given timeframe, the Monnry Loyalty card will be automatically and permanently deactivated, including the loss of accumulated points and associated benefits. The mere act of claiming a prize (in the case of promotions) or a benefit, as well as simply requesting the Monnry Loyalty card as described in these regulations, implies that the participant is aware of the promotion's terms and conditions. Monnry may implement any security measures it deems necessary to protect its interests. The sponsor's responsibility ends with the delivery of the product(s) corresponding to the redemption. The sponsor will not intervene in, nor will it be liable for, any inconveniences, problems, or disputes related to the possession and/or ownership of the card or its misuse. These conflicts must be resolved by the parties involved, and if they cannot resolve them, they must resort to an Alternative Dispute Resolution (ADR) tribunal. The sponsor will never be required to resolve the problem. Monnry will immediately suspend the promotion, without assuming any liability, if any mechanisms of any nature are detected that affect or could seriously affect the interests of the institution or the promotion. Likewise, it may take all necessary actions to prevent individuals from exploiting the promotion, information, content, or any other element that could be used to the detriment of other participants. Direct employees of the sponsor and those associated with the Monnry Lighting store are ineligible to register for or participate in the Monnry Loyalty program. If a direct employment, contractual, or legal relationship is established, any decision regarding the Monnry Loyalty card and its representation will be completely nullified.
